STANDARD FORM CONTRACT BETWEEN ONLINE STORE MONAMOON AND ITS CUSTOMERS MONAMOON standard form contract is a document that defines the procedure for the trading through the online store, in accordance with the applicable laws of Ukraine, which is a standard form contract for trading and the provision of Services related to the registration of a purchase and its delivery, the text of which is presented on MONAMOON online store website monamoon.com.ua
TERMS AND DEFINITIONS
The following terms have the following definitions:
Authorization – is an entrance to the personal cabinet of the Customer, which consists of indicating the login and password of registered Customers in the corresponding fields of the web page and clicking the "Login" button.
Activation – is a procedure carried out in accordance with the procedure and conditions established by this document, which assumes verification of the Customer’s data, giving the User the right and technical opportunity to make a purchase using the online store.
Acceptance – means full and unconditional acceptance by the User (Customer, Buyer) of the standard form contract terms. Since the acceptance of the standard form contract terms, the Owner of online store and the User (Customer, Buyer) become the Parties.
Blocking – are technical and organizational actions, carried out by authorized employees of the online store, aimed at restricting or suspending the ability of the User (Customer, Buyer) to gain access to the website Services in order to prevent and as preventive measures against violations of this document in the manner specified in it.
Purchase/sale agreement (transaction) – is a transaction concluded using the online store by the Seller and the Buyer in order to make a commodity-money exchange between them. The terms of the transaction are established by this document. Order – means the Buyer's request for the purchase of the Goods selected in the online store, duly executed via the electronic form on the website by the Customer himself and/or via communication by telephone through the call-center employee. Confirmation of the fact of placing the Order is the assignment of a unique identification number.
Online store MONAMOON – is the Internet site located at the address http://monamoon.com.ua/ where you can find products offered by the Seller for purchase, as well as terms of payment and delivery of Goods to Buyers (Customers).
Information of a private nature – means personal data of the Customer, information that allows, when used separately or in combination with other available information, to identify the Customer.
Customer – is a registered User.
Authorization code - means the Customer’s account and his personal unique identifier on the site, which is access to the personal cabinet of the Customer.
Code word - is a unique word (a combination of words, letters, and numbers) that is used to identify and verify the User.
Party - is the Seller or the Buyer according to the transaction.
User/Customer Login (User/Customer name) - is the identifier of the User/Customer on the site, which serves to designate it in the system, which is simultaneously used to access the personal page of the User/Customer, as well as for other purposes specified in this document.
Standard form contract (Offer) - is an agreement in which the Seller undertakes to commit the sale of Goods to anyone who beat a path to him.
The password for access to the account - is an analog of the Customer’s handwritten signature, which is used to identify the Customer and serves as the electronic signature of the User/Customer.
Personal cabinet of the Customer - is a data set on a website that contains information about the Customer's personal data, the date of registration, transactions performed by the Customer, purchased Goods, amounts and payments, as well as other information. Buyer - is a Customer who has concluded a contract for the sale of Goods by placing an Order and receiving confirmation of an Order from the Seller and making a purchase of a Product or service via online store.
User (potential Customer) - is an individual who, as a result of navigating to the website address using a web browser or any other program and/or technical devices, has the opportunity to display the content of the website’s web pages and, depending on the actions taken by him, may acquire the status of Customer and Buyer.
Seller - is a business entity that, on sufficient legal grounds, sells Goods to the Customer or offers them for sale.
Registration - is the procedure for creating the User’s personal page on the site http://monamoon.com.ua/, during which the User, by filling in the appropriate forms, provides the system with the information necessary for using the site’s Services. Registration is considered complete only if all its stages are successfully completed in accordance with the instructions published on the site. The acceptance by the User of the terms of this document is a mandatory step in the registration procedure. Upon completion of the registration procedure, the User acquires the status of a Customer.
Website - is an online store at https://monamoon.com.ua/ (the "Site"), which is a communication platform for posting information about Goods and Services, the conditions for their sale and interaction with the online store.
Technical support service (client-service) – is the employees of the online store (third parties involved on a contractual basis), directly managing the site, performing technical, organizational and other functions to ensure the functioning of the site and its Services, information, consulting and other support to the Site Users, Customers, Buyers. Client-service - is the employees of the online store who provide Services to the Customers before, during, and after the purchase of the Goods.
The Owner of online store MONAMOON - is Sole proprietorship Mazur Natalia Anatolievna, taxpayer card: 2857420466, the legal user of registered intellectual property rights to the mark for MONAMOON Goods and Services (word mark and graphical symbol).
The content of the online store website - is protected results of intellectual activity, including graphic, textual, photographic, derivative, composite and other works, user interfaces, visual interfaces, trademark (trademark for Goods and Services), logo, computer programs, databases as well as the design, structure, choice, coordination, appearance, general style and arrangement of this content included in the site and other objects of intellectual property rights altogether and/or separately, specified on the website of the online store at http://monamoon.com.ua/.
Good (s) - is a product (products, items, accessories) not limited in economic/civil circulation that is subject to sale through the online store MONAMOON.
Price - is the expression in cash of the equivalent unit of Goods on the online store MONAMOON website.
The terms used to denote the functions of the site, its functional elements, sections, and individual Services are used in the form in which they are used in the interface of the site.

GENERAL PROVISIONS
The Owner of the online store MONAMOON - is Sole proprietorship Mazur Natalia Anatolievna, registered in the prescribed manner and acting in accordance with the laws of Ukraine (date and number of the record on state registration: 01.16.2012 № 2 068 000 0000 023693), correspondence address 04073, Kyiv, 17B Kurenivskyi Lane, operating through the Internet resource https://monamoon.com.ua/ and related Services.
This User Agreement governing the relations of the online store MONAMOON in the field of the sale to the Customers offered by the Seller using the online store.
This User Agreement governs the use of the site’s Services, as well as all relations between the User (Customer, Buyer) and the online store related to the use of the site’s Services.
Using any of the site Services or taking advantage of any of its functionality, the User (Customer, Buyer) confirms that he is familiar with these Rules and all other conditions set forth on the pages of the site, expresses his unreserved consent with all the conditions of these Rules, understands and accepts the terms of the standard form contract in full without any exceptions and reservations and agrees to fulfill them in full, and also immediately stop using the Services in case of disagreement with any of the condition. The user confirms that he is informed about the distribution of the terms of the Rules to all currently existing site Services, as well as to any development and/or addition of new Services.
The acceptance of the terms of the standard form contract is considered the fact of using the site by the User, which occurs at the time of the start of such use, namely: the passage of the User to his address using a web browser or any other program and/or technical devices that make it possible to display the contents of the web site pages. If the User (Customer, Buyer) for some reason does not agree with the terms of these Rules in completely or in part, the Owner of the online store MONAMOON asks him to leave this site. All messages, notifications, complaints and any other correspondence sent to each other by the standard form contract Parties are considered to be sent properly in electronic form via e-mail messages, as well as in the form of messages within the site, in the manner provided for by its functional features (forum messages, feedback, publication, etc.). Correspondence is also considered to be sent in the proper way if it is sent by the Parties in writing with the necessary details in the manner prescribed by the current legislation of Ukraine.
The Owner of the online store reserves the right to change this Agreement without any special notice to third parties. The new version of the User Agreement shall enter into force upon its posting on the website unless otherwise provided by the new version of the Agreement. The current version of the User Agreement is on the page at http://monamoon.com.ua/ in the "Buyers" section.
The copyright of the online store Owner and/or third parties whose rights have been transferred to the site Owner legally in the framework of this project protect all content of the online store MONAMOON website. Using the site materials without the consent of the copyright holders is not allowed. For the legitimate use of the materials of the site, it is necessary to conclude licensing agreements (obtaining licenses).
When quoting materials from the site, including copyrighted works, a link to the site is required and possible only after prior agreement with the Owner of the online store.

ONLINE STORE AND USER RELATIONSHIPS
Mutual rights and obligations are displayed and detailed in these Interaction rules. The Owner of the online store recommends that persons under the age of 18 refrains from accessing personalized site Services. Online store MONAMOON does not intentionally collect information received from young persons, including personal data, does not use and does not direct the content of the site to young persons. Young persons will take responsibility for their actions including the purchase of Goods via online store using the site.
The right to use the Services of the online store is available to individuals who have reached the age of 18 years and have the full legal capacity - including the right to conclude contracts that are legally binding in accordance with the current legislation of Ukraine. To confirm the status of the Customer of the online store MONAMOON, you need to fill out the registration form. In this case, the Owner of the online store reserves the right to reject any purchase request, to block the User (Customer) without indicating reasons.
The user assumes obligations not to take actions that may be considered as contradicting and violating Ukrainian legislation or international law, including in the field of intellectual property law, copyright and/or related rights, as well as any actions that lead or may lead to violation of the normal operation of the site and site Services.
Nothing in this Agreement can be understood as the establishment between the User (Customer, Buyer) and agency relations, partnerships, joint activities, personal hiring relationships of the online store, or any other relations not expressly provided for in the Agreement.

User (Customer, Buyer) has the right to: - proper and safe quality of the Goods (products) and Services; - gain access to the use of the site after compliance with registration requirements; - the necessary, accessible, reliable and timely information given in the state language about the product, its quantity, quality, assortment, its manufacturer (contractor, seller) in accordance with applicable national legislation; - use all the Services available on the site, as well as purchase any Goods offered on the site; - ask any questions related to the Services of the online store for details that are on the site in the "Contacts" section; - use the site exclusively for the purposes and in the manner prescribed by the User Agreement, and not prohibited by the legislation of Ukraine; - at any time, require the online store to delete the Authorization code and/or block personal cabinet of the Customer on the online store’s website on the basis of a corresponding request sent to the Owner of the online store in writing. - for compensation for property and moral damage caused as a result of product defects (product defect), in accordance with applicable national legislation; - to protect violated rights in the prescribed manner and legally defined ways. User Obligations (On Registration)
To purchase the Goods from the catalog of the online store MONAMOON on the site, as well as to access personalized Services of the site, the User agrees to provide reliable and complete information on the issues specified during Registration and necessary to fulfill obligations on the part of the online store regarding the purchased Goods and/or access to personalized site Services. The user also agrees to keep this information up to date. If incorrect information is provided, or if the Owner of the online store has serious reasons to believe that the information provided by the User is incomplete and/or false, the Owner of the online store has the right to block the Customer’s personal cabinet and/or delete the Authorization code and refuse the User (Customer) in using their Services. In case of subsequent detection of the inaccuracy of the information provided by the Customer (Buyer), the Seller/Owner is not responsible for the consequences associated with such inaccuracy, and the Customer unilaterally compensates for the damage caused to the Owner and/or third parties.
User Obligations (Using the Site Services)
The User (Customer) assumes the obligation not to use the Services of the site in order to: violate of the rights of the young persons and/or harm to them in any form; impair of minority group right; impersonate (registering under an assumed name) and/or a representative of an organization and/or community without sufficient rights, including employees of the online store MONAMOON; mislead regarding the properties and characteristics of any Products from the catalog of the online store on the site; incorrect comparison of the Goods, as well as the formation of a negative attitude towards persons not using certain Goods, or the conviction of such persons; download content that the User (Customer) does not have the right to make available under the laws of Ukraine or according to any contractual relationship; download content that affects and/or contains any patent, trademark (mark for Goods and Services), trade secret, company name, copyright, and related rights, as well as other rights to intellectual property results, owned or lawfully used by third parties; download of advertising information and/or spam not specifically authorized; collection and processing of personal data, information on the privacy of any persons; violate the normal operation of the website of the online store MONAMOON; violate the laws of Ukraine and/or international law. The User (Customer) assumes the obligation not to use abusive words, obscene and abusive images, comparisons and expressions, including in relation to gender, race, nationality, profession, social category, age, the language of a person and citizen, as well as in relation to organizations, state authorities, and local self-government, official state symbols (flags, emblems, anthems), religious symbols, objects of cultural heritage (historical and cultural monuments).
The User (Customer) acknowledges and agrees that the online store MONAMOON has the right (but not the obligation) at its discretion to refuse to post and/or delete any content available through the personalized Services of the site.
Obligations of the User (Customer, Buyer) when purchasing Goods through the online store:

Obligations of the User (Customer, Buyer) when purchasing Goods through the online store:
- before starting the usage of the acquired Goods, carefully read the operating rules (storage, washing) set forth in the labels (hereinafter referred to as “Composition”) sewn into the inside part of clothes;
- if it is necessary to clarify the terms and conditions of use of the Goods - before using the Goods, seek clarification from the Seller (Technical support service);
- use the Goods in accordance with its intended purpose and adhere to the conditions established by the manufacturer of the Goods in the Composition of clothes.
The Owner of the online store strictly prohibits to: use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy, or track the contents of an online store website; disrupt the proper functioning of the site and its sections; by any means bypass the navigation structure of the site to obtain or attempt to obtain any information, documents or materials by any means that are not specifically provided by the Services of this site; unauthorized access to the functions of the site, any other systems or networks related to this site, as well as to any Services offered on the site; violate the security system or authentication on the site or on any network related to the site; perform a reverse search, track or try to track any information about any other User of the site; use the site and its contents for any purposes prohibited by the legislation of Ukraine, as well as incite to any illegal activity or other activity that violates the rights of the online store or other individuals and/or legal entities. Customer Information Support
The Customer gives his voluntary consent to inform him about all the actions of the online store related to the provision of Services, including the status of the Order, as well as other events of any nature related to the personalized Services of the site. Informing is carried out by sending a notification via e-mail and/or SMS-notifications to the mobile phone number provided by the Customer at the time of registration on the site. The online store does not bear any responsibility for delays, failures, incorrect or untimely delivery, deletion or failure to save any notifications. In the event that during the warranty period it is discovered that there are significant deficiencies that have arisen through the fault of the manufacturer of the Goods, confirmed, if necessary, by expert opinion, the Buyer has the right, at his discretion, to demand from the Seller at his discretion to demand the termination of the contract and return of the sum of money paid for the Goods; a replacement for the same product, gratuitous elimination of defects. The Buyer of the rules for using the Goods or storage conditions cannot satisfy buyer’s requirements if the Seller, based on an expert opinion, proves that defects in the Goods arose because of a violation. The funds paid by the Buyer (Customer) for the Goods are returned to the Buyer (Customer) on the day of the return of the Goods, and in the case of payment for the Goods by bank card or bank transfer, the period for returning funds is within 7 (seven) days following the day of receipt by the Seller of the Buyer's written application with all accompanying documents, returned Goods, provided that complete and correct data is filled. The cost of courier delivery of the Goods in case of exchange or return is borne by the Buyer.
Refund Application
The application for a refund is filled out by the Customer in the form provided by the Seller with the application of the rules established by the current legislation of the Seller's country. Refunds are made using the rules established by the current legislation of the Seller’s country.
Return Act
The return act of Goods is drawn up in the form provided by the Seller with the application of the rules established by the current legislation of the Seller's country.
Warranty and After-sales Service
If there is a document confirming the purchase of Goods, the Buyer, the Customer contacts warranty service center of the store. The warranty covers the defects of the Goods that arose due to the fault of the manufacturer. Replacement of low-quality parts of the Goods and related work is free of charge. The warranty period of operation for the Goods begins from the moment of sale of the Goods and ends on the 45th calendar day from the date of purchase taking into account the terms stipulated by the current legislation of Ukraine. The warranty period of operation increases for the duration of the stay of the Goods (products) in the repair. The applicable laws of the Seller’s country govern all warranty conditions.
During the warranty period, the following is allowed and is not a defect: Depreciation of parts of the Goods (products), as well as its external and internal coating during operation. Shrinkage or stretching of the materials (fabrics) of the Goods during operation and cleaning (washing) within the normal range. Deviation of the characteristics of the Goods (product) from those specified in the documentation within the normal range.
Refund Application
The application for a refund is filled out by the Customer in the form provided by the Seller with the application of the rules established by the current legislation of the Seller's country. Refunds are made using the rules established by the current legislation of the Seller’s country.
Return Act
The return act of Goods is drawn up in the form provided by the Seller with the application of the rules established by the current legislation of the Seller's country.

The warranty does not cover:
- The Goods in accordance with the legally approved list of Goods of good quality, not subject to exchange (return);
- Products that have signs of operational disruption, including, but not limited to, tears, stretching, tightening, traces of impacts and mechanical damage: dents, nicks, minor scratches, signs of deformation, improper cleaning, or other violations of the proper operation of the Product.
- Damage (external or internal) caused by any mechanical impact, shock or vibration loads, application of external force to parts of the Product, cracks, chips, scratches, seizure of surfaces, deformation of materials and parts, etc.
- Damage due to exposure to Goods (products) of caustic chemicals or solvents.
- Damage to the Goods (products) associated with the loss of stones and other decorative elements. Warranty is not valid in cases of:
- violation by the Buyer (Customer) of the operating rules or misuse of the Goods (product).
- the Buyer (Customer) has no documents confirming the purchase of the Goods (product).
- appeals of the Buyer (Customer) to the Customer service center after the end of the warranty service period.
DISPUTE RESOLUTION AND APPLICABLE LAW
Disputes arising because of a violation (possible violation) of the terms of this User Agreement are resolved through negotiations. If, based on the results of the negotiations, it is not possible to resolve the dispute, its further consideration is carried out in court in accordance with the norms, rules, and procedures established by the legislation of the Seller’s country (Ukraine).
